Personal Injury

Your Recovery Comes First

After a serious accident, your health matters most. Prompt, consistent medical care protects your well-being and creates a clear record of your injuries. We want to understand not only how you are hurt today, but how your injuries may affect your work, your family, and your future.

While you focus on healing, we take care of the legal side of your claim.

  • Investigating the cause of the accident and identifying every responsible party
  • Documenting your medical treatment, bills, and lost income
  • Working with medical and financial experts to estimate future costs
  • Handling communication and negotiations with insurance companies
  • Taking your case to court if a fair settlement is not offered

Damages You May Be Able to Recover

An injury affects far more than your health. Maryland law allows injured people to seek compensation for both the financial costs and the personal toll of an accident caused by someone else’s negligence.

Medical Expenses

Emergency care, hospital stays, surgery, therapy, medication, and the treatment you will need in the future.

Lost Income

Wages you missed while recovering, along with any reduction in your ability to earn a living going forward.

Pain & Suffering

Physical pain, emotional distress, and the loss of enjoyment of activities that were part of your daily life.

Property Damage

Repair or replacement of your vehicle and other personal property damaged in the accident.

Out-of-Pocket Costs

Travel to medical appointments, help at home, home modifications, and other expenses caused by your injury.

Wrongful Death

When a loved one is lost, families may seek funeral costs, lost financial support, and loss of companionship.

Maryland caps noneconomic damages, such as pain and suffering, in most personal injury cases. Economic damages, such as medical bills and lost wages, are not capped.

How a Personal Injury Claim Works

Every claim is different, but most follow the same general path from the first conversation to a resolution. Here is what you can expect along the way.

  1. Free Consultation

We listen to what happened, review your injuries and any documents you have, and explain your options.

  2. Investigation

We gather police reports, photographs, witness statements, and other evidence to establish who was at fault.

  3. Treatment & Documentation

While you complete your treatment, we collect your medical records and bills to show the full extent of your injuries and losses.

  4. Demand & Negotiation

We present a detailed demand to the insurance carriers and negotiate for a settlement that reflects the full value of your claim.

  5. Litigation

If a fair settlement is not offered, we file suit and prepare your case to be presented in court.

What It Takes to Prove Negligence

Most personal injury claims are built on negligence. To recover compensation, you must show four things, and each one depends on strong, well-documented evidence.

That evidence can include police reports, photographs and video of the scene, witness statements, medical records, and, when needed, testimony from accident reconstruction or medical experts.

Under Maryland’s contributory negligence rule, an injured person who is found even slightly at fault may be barred from recovering anything, which makes a thorough investigation especially important.

  1. Duty of Care

The other party owed you a duty to act with reasonable care, such as a driver’s duty to follow traffic laws.

  2. Breach of Duty

They failed to meet that duty through careless, reckless, or unsafe conduct.

  3. Causation

Their failure directly caused the accident and the injuries you suffered.

  4. Damages

You suffered real losses, such as medical bills, lost income, or pain and suffering.

Choosing the Right Personal Injury Firm

Hiring a personal injury attorney is an important decision. You owe it to yourself to hire a law firm that has a long track record of success in building strong legal cases and dealing with insurance companies. You want a firm that understands that the full value of a personal injury case often takes time to discern. You also want one that isn't interested in quick settlements when that compromises the client's interests.

You should also look for a firm that genuinely cares about you, is responsive to your questions, and keeps you appraised of the status of your case every step of the way.

Personal Injury FAQs

Answers to common questions about personal injury claims in Maryland.

How long do I have to file a personal injury lawsuit in Maryland?

In most cases, a personal injury lawsuit in Maryland must be filed within three years from the date the claim arises, which is usually the date of the injury. Some claims follow different deadlines, and missing the deadline can permanently bar your claim, so it is important to speak with an attorney early.

What if I was partly at fault for the accident?

Maryland follows the rule of contributory negligence. If you are found to have contributed to your own injury, even slightly, you may be barred from recovering compensation. Maryland is one of only a handful of jurisdictions that still follow this rule, which is why careful investigation and strong evidence about fault are so important from the start.

How is the value of my case determined?

Every case is different. The value of a claim generally depends on the severity of your injuries, your past and future medical expenses, the income you have lost or will lose, how the injuries affect your daily life, and the strength of the evidence about who was at fault.

Is there a limit on how much I can recover?

Maryland caps noneconomic damages, such as pain and suffering, in most personal injury and wrongful death cases. The cap increases by $15,000 every October 1, and the amount that applies depends on when the claim arises. There is no cap on economic damages, such as medical bills and lost wages. Medical malpractice cases follow a separate cap.

Should I accept the insurance company’s first offer?

Speak with an attorney first. Early offers are often made before the full cost of your injuries is known, and once you sign a release you generally cannot seek more, even if your condition gets worse. Statements you give to an adjuster can also be used to argue that you were partly at fault.

How long will my case take?

It depends on your injuries and whether fault is disputed. In many cases it is wise to wait until your medical treatment is complete, so the claim reflects the full extent of your injuries. Cases that settle can resolve sooner, while cases that go to trial take longer.

What should I do after an accident?

Get medical attention right away, even if you feel fine. If you can, report the accident, take photos of the scene and your injuries, and collect contact information from witnesses. Keep copies of your medical records, bills, and any correspondence, and avoid discussing fault with anyone other than your attorney.
