How a Civil Case Moves Forward

Every case follows its own path, but most civil lawsuits in Maryland move through the same general stages. Here is what you can expect along the way.

  1. Case Evaluation

We review your documents, timeline, and goals, then identify the claims, defenses, and filing deadlines that apply.

  2. Filing & Pleadings

The case formally begins when a complaint is filed. The other side then responds with an answer or preliminary motions.

  3. Discovery

Both sides exchange documents, answer written questions, and take sworn testimony in depositions to establish the facts.

  4. Mediation & Settlement

Courts often refer civil cases to mediation or another form of ADR, and many disputes are resolved at this stage.

  5. Trial & Appeal

If the case does not settle, it is presented to a judge or jury. A final judgment may then be reviewed on appeal.

For example in a case of a breach of a commercial contract these questions are often asked:

  • Have the parties reached an agreement?
  • How much money can you expect to receive?
  • What provisions of the agreement are helpful to your case?
  • Which part of the agreement was not fulfilled?
  • What action needs to be taken to compensate someone for his or her loss or injury?
  • Can you collect attorney's fees and costs?

Civil Litigation FAQs

Answers to common questions about civil lawsuits in Maryland.

How long do I have to file a civil lawsuit in Maryland?

In general, a civil action in Maryland must be filed within three years from the date the claim accrues. Some claims have different deadlines, and the clock does not always start on the date of the harm, so it is important to speak with an attorney early. Filing after the deadline can permanently bar your claim.

Which court will hear my case?

It often depends on the amount in dispute. The District Court of Maryland has exclusive jurisdiction over civil claims of $5,000 or less and shares jurisdiction with the circuit courts for claims above $5,000 and below $30,000. Contract and tort claims for more than $30,000 are heard in circuit court. The District Court does not hold jury trials.

Will my case go to trial?

Not necessarily. Many civil disputes are resolved through negotiation, settlement, or alternative dispute resolution before trial. Maryland circuit courts may order the parties to mediation, and in Montgomery County mediation can be ordered at any point while a civil case is pending.

What is the difference between mediation and arbitration?

In mediation, a neutral mediator helps the parties reach their own voluntary agreement but does not decide the case. In arbitration, a neutral arbitrator hears the evidence and issues a decision, which may be binding depending on the parties’ agreement or the rules that apply.

What should I bring to my consultation?

Bring any documents related to your dispute, such as contracts, leases, invoices, correspondence, insurance policies, notices, and any court papers you have received. A short timeline of key events is also helpful.
